Criteria for directing - criminal investigation / administrative enforcement procedure
Following are details of the criteria for choosing between a criminal investigation under the relevant provisions in Chapter J of the Securities Law 5728-1968 (hereinafter - "the Law") and investigating a breach or opening an administrative procedure under Article Two of Chapter Eight "D" of the Law.
1. The seriousness of the act or omission and its circumstances;
2. An assessment of the nature and strength of the evidence;
3. An examination of The Security Authority's enforcement policy.
